The Delhi High Court has declared ‘WIPRO’, popular for consumer care products and lighting business, as a well known trademark under Section 2(1)(zg) of the Trade Marks Act 1999.
Justice Tejas Karia observed that Plaintiff-Wipro Enterprises Private Limited has been using the Mark ‘WIPRO’ continuously and uninterruptedly at least since the year 1977 and has earned considerable goodwill and reputation in India.
“The Plaintiff has also spent a large amount of money as promotional expenditure between the Financial Years 1994-95 and 2023-24, which stands at INR 8,800/- crores and has led to the Mark ‘WIPRO’ becoming synonymous with the Plaintiff alone,” the judge added.
The development comes in a suit filed by Wipro against Defendants’ application for registration of the mark “SHIVAM UDHYOG WIPRO WIRE MESH” in Class 06 (common metals and their alloys).
Wipro argued that it has built global reputation and the impugned application using its mark would violate its intellectual property rights.
During the hearing, the Defendants undertook to withdraw their application, subject to Wipro not pressing its prayer for damages and cost.
As Wipro agreed, the Defendants withdrew its application and undertook to not use ‘Wipro’ or any other deceptively similar mark.
